Geographical indications:
Geographical Indication is the intellectual property right by which indications
which identify the goods as originating in certain territory or a region
or a locality in that territory, whose natural or social factors affect
a given quality, reputation or other characteristic of the goods, are
registered.
Geographical indication may also be registered for the name of the goods
which has been recognized, due to a long-term use in commerce, as an indication
that that the goods originate in certain locality or region.
Geographical indication may be used for natural products, including agricultural,
industrial and manufactured products.
Geographical indications are protected as intellectual property in order
to prevent the misuse or unauthorized use thereof, since they contribute
to the greater market value of products which corresponds to their specific
features and reputation obtained thereby.
Geographical indications cannot become generic names, the use of which
would be free in commerce. |
